RESOLUTION
#2010-77
RESOLUTION AUTHORIZING REIMBURSEMENT TO REGENCY WALK HOMEOWNERS ASSOCIATION PURSUANT TO N.J.S.A. 40:67-23.2 et seq., AS AMENDED, FOR THE YEAR 2009
WHEREAS, Regency Walk Homeowners Association (the “Association”) is a qualified private community pursuant to Chapter 299, Public Law 1989, as amended (the “Law”); and
WHEREAS, the Borough of Helmetta is required to reimburse the Association for certain municipal services pursuant to the Law; and
WHEREAS, if the Borough provides reimbursement to the Association for certain municipal services, the reimbursement shall not exceed the amount that the Borough would have expended to provide the equivalent services; and
WHEREAS, the Borough and the Association entered into an Agreement around March 17, 2004 establishing the reimbursement procedure for covered municipal services; and
WHEREAS, the Association submitted bills from HMD Lawn Service LLC for snow removal costs in 2009 in the amount of $17,736.32; and
WHEREAS, the Borough Administrator has determined that, under the Borough’s agreements in place for 2009, it would have cost the Borough $687.31 to provide equivalent snow removal services to Regency Walk; and
WHEREAS, the Association submitted bills from Jersey Central Power & Light for street lighting for the year 2009 in the amount of $3,452.31; and
WHEREAS, the Association recycled leaves in 2009 at an undetermined cost due to a lack of separate line items on the invoice; and
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Helmetta that the Chief Financial Officer be and is hereby authorized to issue a check in the amount of four thousand one hundred thirty-nine dollars and sixty-two cents ($4,139.62) to Regency Walk Homeowners Association representing 2009 snow removal reimbursement of $687.31, and 2009 street light reimbursement of $3,452.31.
RESOLUTION

A RESOLUTION AUTHORIZING DR. BRIAN SAVAGE TO PERFORM CONSULTING SERVICES RELATED TO THE SCHOOL DISTRICT CONSOLIDATION FOR THE BOROUGH OF HELMETTA
WHEREAS, pursuant to N.J.S.A. 18A:7-8, the Helmetta School District, which was a non-operating school district, was consolidated with the Spotswood School District; and
WHEREAS, N.J.S.A. 18A:8-1, et seq. imposes various financial and other requirements upon the dissolution of a non-operating school district; and
WHEREAS, Dr. Brian Savage previously served as the administrator of the Helmetta School Board and is familiar with the issues that the Borough must address during the consolidation process; and
WHEREAS, the Borough wishes to retain Dr. Brian Savage to serve as a consultant on behalf of the Borough with regard to issues arising from the elimination of the Helmetta School District, including but not limited to the final audit of the Helmetta School District’s accounts and financial transactions and the return of any remaining cash balances to Helmetta Borough.
NOW, THEREFORE, BE IT RESOLVED by Borough Council of the Borough of Helmetta that Dr. Brian Savage is hereby authorized to provide consulting services with regard to issues arising from the dissolution of the Helmetta School District at a rate of $75.00 per hour in an amount not to exceed $3,000.00 and the Mayor is hereby authorized to execute any and all documents necessary to effectuate the provision of these services.
BE IT FURTHER RESOLVED, that the Chief Financial Officer has executed a Certification of Funds for this contract, which is attached hereto, and that sufficient funds are available for said contract from Account Number 0-01-20-110-022.
BE IT FURTHER RESOLVED that the Borough Clerk is hereby directed to provide a certified copy of this Resolution to each of the following:

MIDDLESEX COUNTY CDBG PROJECT
WHEREAS, a Public Hearing was held on January 27, 2010 to discuss
Municipal Projects for the 2009 Community Development Block Grant; and
WHEREAS, the meeting was opened to the Public for discussion but there being no one in the audience, the meeting was closed to the Public; and
WHEREAS, discussion ensued with the members of the Borough Council; and
WHEREAS, it was the consensus that the money be spent on slip linings and were advised that this is ineligible; and
WHEREAS, at the meeting on February 24, 2010 discussion was held and it was decided that Washington Street be paved and we were advised that this too would be ineligible;
NOW THEREFORE BE IT RESOLVED, that the Community Development Grant Money of $29, 700 be used for curb cuts for handicap accessibility.

Mayor Martin announced that the Spring Fling party will be held on Sunday March 14 at 1:00 p.m. Borough Attorney David Clark had no report. Borough Engineer Jason Cline was asked
Questions regarding the proposed kennel. After a lengthy discussion it was the consensus that we should reach out to Renaissance to find out the cost of the property and if they have an information on the environmental issues. If it is feasible then we should reach out to Kaplan. We should also consult with the Auditor to find out how much the payments will be.

WHEREAS, Section 8 of Chapter 231, Public Law 1975 permits the exclusion of the General Public from a meeting of the Governing Body under certain circumstances; and
WHEREAS, the Mayor and Borough Council of the Borough of Helmetta are of the opinion that such circumstances presently exist;
NOW THEREFORE BE IT AND IT IS HEREBY RESOLVED by the Mayor and Council of the Borough of Helmetta, in the County of Middlesex, State of New
