PAYMENT FOR APPRAISAL SERVICES
 
        WHEREAS, there was a need of appraisal services in the Borough of Helmetta;
and
          WHEREAS, Gagliano & Company submitted a bid and were awarded the work
      as per Resolution 08-231, and                                                                        
                       WHEREAS, the work was completed;
               NOW THEREFORE BE IT RESOLVED that the CFO is hereby authorized to issue a check in the amount of $12,500 Gagliano & Company for performing the appraisal on Parcels 1-4 of the Helme Redevelopment area.

RESOLUTION SUPPORTING SENATE BILL S-1 WHICH MAKES          SIGNIFICANT REFORMS TO THE FAIR HOUSING ACT (FHA) AND ABOLISHES THE COUNCIL ON AFFORDABLE HOUSING (COAH)
 
                  WHEREAS, Senate Bill S-1 was recently introduced and is currently under review by the Senate Economic Growth Committee; and
            WHEREAS, Senate Bill S-1, if adopted, would abolish COAH and eliminate the statewide calculation of need by replacing COAH with the State Planning Commission; and
                        WHEREAS, the purpose of Senate Bill S-1 is to repeal COAH’s micro-managed and complex bureaucracy which has burdened property taxpayers with millions of dollars in unnecessary costs of compliance; and 
                              WHEREAS, the new system would allow municipalities to determine if they have already met the inclusionary housing standard and can adopt a simple ordinance to declare their compliance; and

                        WHEREAS, this new approach is free from complex, confusing and costly state requirements and will help to reduce the costs to municipalities; and
                        WHEREAS, although Senate Bill S-1 allows regional contribution agreements (RCA) to be used in certain limited circumstances to meet municipal affordable housing obligations, the Borough believes Senate Bill S-1 should be amended to allow RCAs to be utilized in additional circumstances.
                        NOW THEREFORE BE IT RESOLVED by the Borough Council of the Borough of Helmetta that the Borough Council strongly supports the adoption of Senate Bill S-1 and urges the members of the Senate Economic Growth Committee to amend Senate Bill S-1 to allow RCAs to be utilized in additional circumstances.
                        BE IT FURTHER RESOLVED that a copy of this resolution shall be provided by the Borough Clerk to the members of the Senate Economic Growth Committee: Senators Raymond J. Lesniak, Sandra B. Cunningham, Richard J. Codey, Joseph M. Kyrillos, Steven V. Oroho, Robert W. Singer, and Joseph F. Vitale as well as to the Borough’s representatives in the legislature: Senator Barbara Buono and Assemblymen Peter J. Barnes, III and Patrick J. Diegnan, Jr.
 
 
RESOLUTION

RESOLUTION SUPPORTING SENATE BILLS S-2, S-3-S-4 AND SCR-1 WHICH PROPOSE REFORMS TO THE STATE’S PUBLIC EMPLOYEE PENSION AND BENEFITS SYSTEM  
                        WHEREAS, Senate Bills S-2, S-3, S-4 and SCR-1 (the “Bills”) were recently introduced by Senate President Sweeney and Senate Republican Leader Kean; and
                        WHEREAS, the Bills, if adopted, would protect the retirement benefits of rank-and-file public employees and constitutionally require the government to meet its annual pension obligations; and
                        WHEREAS, the Borough believes that pension reform is necessary to address the growing concerns of this State’s employees; and
                        WHEREAS, the Borough wishes to support the Bills and wishes to make this known to the Borough’s representatives in the State Assembly and Senate.   
                        NOW THEREFORE BE IT RESOLVED by the Borough Council of the Borough of Helmetta that the Borough Council strongly supports the adoption of Senate Bills S-2, S-3, S-4 and SCR-1 and urges its representatives in the legislature to vote for the adoption of this bill; and
                        BE IT FURTHER RESOLVED that a copy of this resolution shall be provided by the Borough Clerk to the Borough’s representatives in the legislature: Senator Barbara Buono and Assemblymen Peter J. Barnes, III and Patrick J. Diegnan, Jr.

WHEREAS, the Borough Tax Collector has received applications for Veterans Deductions in the amount of $250.00 for 2010 taxes on property located at 2 Appleby Drive, Block 21 Lot 44 and  21 Borghaus Road, Block 21, Lot 44 so identified on the Borough’s tax map, (the “Property”); and
WHEREAS, the Borough Tax Collector requests authorization from the Borough Council to issue such a deduction to the owner of the Property.
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Helmetta that the Borough Tax Collector is hereby authorized to make such  adjustments for a Veterans Deductions to the Property owners, and
            BE IT FURTHER RESOLVED that the Borough’s Chief Financial Officer is directed to issue refunds in the amount of $250.00 to Property owners Robert Sprance, 2 Appleby Drive, Helmetta, NJ 08828 and $250.00 to Leonard Weiner, 21 Borghaus Road, Helmetta, NJ 08828.

WHEREAS, the Borough Tax Collector has received tax overpayments for the taxes due for the second quarter of 2010 on property listed below:

RESOLUTION AMENDING 2010 TEMPORARY BUDGET APPROPRIATIONS
 
                WHEREAS, in the normal operation of the business of the Borough of Helmetta, it will be necessary for making contracts, commitments and payments prior to the adoption of the regular 2010 budget for the Borough of Helmetta; and

WHEREAS, revised Statute 40A:4-19 of the State of New Jersey provides that the Governing Body of any municipality may make temporary appropriations to provide for any contracts, commitments or payments to be made between the beginning of the budget year and the adoption of the final budget; and
WHEREAS, the 2010 budget will not be adopted until after April 1 and commitments need to be covered until the date of adoption; and
NOW, THEREFORE, BE IT RESOLVED that the following list of appropriations shall constitute an amendment to the 2010 temporary budget of $767,042.00 for the Borough of Helmetta, Middlesex County, New Jersey.

PAYMENT TO ALWAYS SOLID CONTRACTING
                FOR INSTALLATION OF DOORS
 
                                          WHEREAS, Always Solid was awarded the bid for the replacement and installation of                          seven (7) commercial fire grade exterior doors in the amount of $18,800.00; and                                                                    WHEREAS, the work has been completed and money in the amount of $400.00 is
                              being withheld until Spring, 2010 for paint touch up on the doors as needed;
                                          NOW THEREFORE BE IT RESOLVED, that the CFO of the Borough of Helmetta is                                     is hereby authorized to pay Always Solid Contracting in the amount of $18,400.00 for the                               completion of the installation of doors.

                                          WHEREAS, Craig Testing was awarded the bid in the amount of $925.00 for the        
ta                           taking of pavement test cores for the Old Forge Road reconstruction project as required by th                           the New Jersey Department of Transportation; and
                                          WHEREAS, the work has been completed and payment has been recommended by R                          Remington, Vernick and Vena;
                                          NOW THEREFORE BE IT RESOLVED, that the CFO of the Borough of Helmetta is                         is hereby authorized to pay Craig Testing Laboratories, Inc.  in the amount of 925.00 for

AUTHORIZATION TO SIGN SHARED SERVICES AGREEMENT
WITH THE BOROUGH OF SAYREVILLE
    
                              WHEREAS, the Borough of Sayreville is desirous of continuing its
         shared service with the Borough of Helmetta wherein Helmetta will provide animal control          services to the Borough of Sayreville from January 1, 2010 to December 31, 2010; and
                     WHEREAS, the Borough of Sayreville will pay the Borough of Helmetta $1,600.00 per            month as per the contract;
                     NOW THEREFORE BE IT RESOLVED that the Mayor and Borough Clerk are hereby          authorized and directed to execute a shared services agreement with the Borough of
         Sayreville for the provision of animal control services for the year 2010.

RESOLUTION OPPOSING LEGISLATION
AMENDING TIME OF DECISION RULE
 
                      WHEREAS, S-82 and A-437 are intended to modify the “time of decision" rule, which

currently allows municipalities to change the zoning regulations during the pendency of an application for   
development; and
                        WHEREAS, the bills would deem as complete the ordinances in effect at the time of
an application and shall govern the review of that application and any decision made following
upon that review;
                        WHEREAS, "the time of decision rule" is a judicially recognized principal that decisions
are to be made on the basis of laws, ordinances and regulations in effect at the time the decision is rendered
not upon application; and
                        WHEREAS, courts have applied the ·'time of decision rule" to correct errors in zoning
ordinances, thus giving local legislators the opportunity to correct legislative policy that had been found
to be imperfectly expressed; and
                        WHEREAS, the “time of decision rule" has permitted a municipality to give additional
legislative consideration to serious and substantial land use planning concerns that, for whatever reason,
 had not been previously addressed in the ordinance; and
                        WHEREAS, application and zoning changes require public discussion and hearings,
and  S82/A-437 would permit developers to "beat the clock" by filing applications and freezing the       
ability of local officials to act;
                        NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the        
Borough of Helmetta, in the County of Middlesex in the State of New Jersey hereby urges our State
Legislators to    oppose A-4 and S-82, and any legislation which would eliminate the "time of decision"
rule at the local level; and
                        BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to Frank
Lautenberg, State Senator, Frank Pallone, Jr., Assembly representatives, the New Jersey State            
League of Municipalities and the Office of the Governor .

There was a change in the agenda and Mrs. Joanna Samolyk of Lake Avenue was permitted to speak. She had pictures
and was upset because Lake Avenue is becoming a junk yard and automotive repair dept. She presented pictures to the
Council and these will be forwarded on to the Code Enforcer

Clmn. Peckham stated that the CDBG meeting was cancelled due to the weather.
Jason Cline, Borough Engineer, gave a report on the status of the projects in the Borough. The slip
lining is ineligible for the CDBG grant money. The eligible areas are Blocks 2 and 3. After discussion,
 it was the consensus to pave Washington Street. Discussion was held on the Board of Education and
their meeting of March 1. There was also a question as to what happened to our remaining funds. 
Clmn. Perez and Smith will be attending the Board of Education meeting. A resolution will be presented
at our next meeting to hire Brian Savage at $75.00 an hour not to exceed $3,000.00. 
 
* FIRST READING OF ORDINANCE:
   2010-5 - ORDINANCE AUTHORIZING THE APPROPRIATION OF $210,000 FOR  
IMPROVEMENTS TO MADISON DRIVE, SUTTON PLACE AND YORK DRIVE           
IN THE BOROUGH OF HELMETTA, COUNTY OF MIDDLESEX, STATE OF NEW JERSEY,
AND TO APPROPRIATE $20,000 FROM THE GENERAL CAPITAL IMPROVEMENT FUND
AND $190,000 FROM THE NJDOT FISCAL YEAR 2010 MUNICIPAL AID GRANT
                        WHEREAS, the Council of the Borough of Helmetta  (“Council”) desires to
            make improvements to Madison Drive, Sutton Place and York Drive in the Borough of Helmetta             (“Borough”); and
                        WHEREAS, the Council has demonstrated that there currently exists a need to provide
            funding for the improvements to Madison Drive, Sutton Place and York Drive; and  
                        WHEREAS,  the New Jersey Department of Transportation has awarded the Borough a $190,000 Municipal Aid Grant for Fiscal Year 2010 which the Borough has determined to use for the
 Madison Drive, Sutton Place and York Drive improvements; and
                        WHEREAS, the Council will contribute an additional $20,000.00 from the General Capital Improvement Fund to cover additional related expenses.
                        NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED, by the Borough Council
of the Borough of Helmetta, in the County of Middlesex and State of New Jersey that:
Section 1. The improvements described below are hereby authorized as a general improvement to be made
by the Borough of Helmetta, New Jersey.
Section 2. There is hereby appropriated for the improvement the sum of Two Hundred Ten Thousand Dollars ($210,000) as follows:
 
a.                   One Hundred Ninety Thousand Dollars ($190,000) from the New Jersey Department
            of Transportation Fiscal Year 2010 Municipal Aid Grant; and
 
b.                  Twenty Thousand Dollars ($20,000) from the General Capital Improvement Fund
            Section 3.         The improvement for which this appropriation is authorized is the reconstruction of Madison Drive, Sutton Place and York Drive in the Borough of Helmetta.
            Section 4.         The appropriation authorized above shall be funded completely from revenues
received from either State and Municipal governments under grant funds already received or funds set aside
for such purpose.
            Section 5.         The Governing Body of the Borough of Helmetta hereby certifies and assures that all
 of the required assurances which are necessary for such State and Municipal funding for the project have been or shall be met.
            Section 6.         This project will be included in the capital budget in the final adopted budget for 2010.
            Section 7.         This Ordinance shall take effect following its advertisement, public hearing and adoption in accordance with the requirements of law.
